The certificate of origin of the CT-1 form is a document confirming that the products were manufactured in the territory of the Russian Federation or other EAEU countries. In practice, it is used as a tool for admission to purchases and confirmation of the origin of goods under the national regime.
In current regulatory practice, CT-1 most often occurs in two situations: when participating in purchases under 44-FZ and 223-FZ, as well as when supplying to CIS countries. It is especially important for the medical device market, since the origin of products directly affects the possibility of participating in tenders and the application of restrictions on foreign goods.
Chambers of Commerce and Industry are responsible for issuing the certificate. They are the ones who carry out the examination of the origin of the products and assess whether the product meets the criteria of "Russian" or "EAEU-made" production. During the evaluation procedure, the chamber checks not only the documents, but also the logic of production - what components the product consists of, where it is actually produced and what operations are performed on the territory of Russia.
The key point is to confirm the origin. This may be quite obvious for simple products, but for equipment and medical devices the issue is more complicated. In such projects, the production structure is evaluated.:
-where is the assembly taking place,
-which components are imported,
-is there any technological processing.
If, in fact, the product is only completed from ready-made foreign parts, it is usually impossible to obtain the CT-1.
A package of documents is formed for a specific product, but in any case, it is required to disclose the production chain. This usually includes a description of the technology, information about components, cost calculations, supply contracts, and technical documentation. At the same time, problems often arise at the stage of describing the production chain, it is important to carefully check the documents and use the correct wording.
The time required to issue a certificate is usually short - a few business days. However, this is only true if the package is properly prepared. If the Chamber of Commerce and Industry has questions about the origin of the products, the procedure is delayed, and sometimes ends with a refusal.
In procurement, CT-1 is used as one of the ways to confirm the country of origin of the goods. But it is important to understand that in recent years it has not always been a sufficient document. In some cases, customers require the availability of products in the registers of the Ministry of Industry and Trade or the EAEU, especially when it comes to the application of restrictive measures. Therefore, CT-1 should not be considered in isolation, but in conjunction with a general strategy for product access to the market.
