The State Duma adopted amendments to Federal Law No. 44-FZ: increased control over the accuracy of information provided by procurement participants.

On May 27, 2025, the State Duma of the Russian Federation adopted in its third (final) reading a bill aimed at increasing transparency and accountability in public procurement. The amendments affect Articles 31 and 43 of Federal Law No. 44-FZ and clarify the actions of customers and procurement commissions if inaccurate information is discovered in bids submitted by participants.

According to the amendments:

• The procurement commission is obligated to disqualify a participant from participating in the supplier selection process at any time before the results are finalized if the participant does not meet the requirements of Article 31 or has provided inaccurate information.
• The customer is obligated to refuse to enter into a contract after the results are finalized, but before the contract is signed, if it is determined that the participant does not meet the requirements or that the bid contains false information or inaccurate documents.
• The new version also stipulates that the procurement participant is liable for providing inaccurate information and documents, as well as for actions taken based on them. The law is scheduled to enter into force on January 1, 2026.

These changes are aimed at preventing unfair participation in procurement and strengthening trust in the contracting system. It is important for bidders to promptly verify compliance with requirements and ensure the accuracy of all information provided.
